(1) | No person may conduct a take-off in a helicopter with instruments or equipment that are not serviceable or that have been removed unless the helicopter is operated in accordance with a configuration deviation list (CDL), the provisions specified in the aircraft flight manual (AFM) or the conditions or limitations specified in a minimum equipment list (MEL), which has been approved by the Director and, if in the opinion of the pilot-in-command, aviation safety is not compromised. |
(2) | An operator shall establish an MEL for each type of helicopter for which a master minimum equipment list (MMEL) has been approved by the State of Manufacture of such helicopter, provided the State of Manufacture is a Contracting State. |
(3) | No operator may operate a helicopter in accordance with an MEL unless such MEL is carried on board the helicopter. |
