Part 139 : Aerodromes and Heliports

Subpart 1 : General

139.01.18 Movement of aircraft on apron on direction of aerodrome operator

 

(1) The operator of an aircraft which is on the apron shall, on being directed to do so by the aerodrome operator, move such aircraft—
(a) from the position in which it was placed in terms of regulation 139.01.18(2)(a) to another position in the same parking place;
(b) from the parking place in which it was parked in terms of regulation 139.01.18(2)(b) to any other parking place on the apron; or
(c) from the apron,

and if the operator of such aircraft refuses or fails or is not present to comply forthwith with such direction, the aerodrome operator may have such aircraft moved to comply with such direction and may recover the costs incurred in having such aircraft so moved from the operator of such aircraft and any such action by the aerodrome operator shall not exempt such operator from a prosecution in respect of such refusal or failure.

 

(2) An aircraft moved to another position under the provisions of subregulation (1)(a) shall be deemed to have been placed in its new position in terms of regulation 139.01.18(2)(b) and an aircraft moved to another parking place under the provisions of subregulation (1)(b) shall be deemed to have been parked in its new parking place in terms of regulation 139.01.18(2)(a).

 

(3) An aerodrome operator shall, when justified by the volume of traffic and operating conditions as determined after a risk assessment, provide an apron management service order—
(a) to control movement with the objective of preventing collisions between aircraft between aircraft and vehicles and between aircraft and obstacles;
(b) to control entry of aircraft into and out of the apron with the assistance of an aerodrome control tower; and
(c) to ensure safe and expeditious movement of vehicles.

(4) An aerodrome operator shall establish procedures to facilitate the orderly transition of aircraft between an a apron management unit and ATSU.

(5) An apron management service referred to in subregulation (3) shall be provided with radiotelephony for communication.

(6) An  apron management service shall visually monitor an aircraft stand as prescribed in Document SA-CATS 139, to ensure  that the required clearance distances are complied with by aircraft using such a stand.
