The operator of a non-type certificated aircraft used for the provision of flight training or in commercial air transport operations, as the case may be, shall not operate the aircraft unless such operator is the holder of a valid—
| (a) | ATO approval, issued in terms of Part 141; or |
| (b) | licence issued in terms of the Air Services Licensing Act, 1990; and |
| (c) | operating certificate issued in terms of regulation 96.04.3. |
