| (1) | The Minister may delegate a power or duty vested in him or her in terms of this Act, excluding the power to make regulations in terms of section 30, in accordance with section 42 of the National Environmental Management Act. |
| (2) | An MEC may delegate a power or duty vested in or delegated to him or her in terms of this Act in accordance with section 42A of the National Environmental Management Act. |
