Where any proceedings are instituted by or through and in the name of the nominee company in respect of a participation bond included in a scheme, the participants in that scheme may be required to refund to the nominee company, or the manager, as the case may be, pro rata any of the costs of the proceedings that may not be recovered by the nominee company or the manager from the mortgagor.
