Constitutional Court Complementary Act, 1995 (Act No. 13 of 1995)5. Issue of process against member of Court |
1) | Notwithstanding anything to the contrary in any law contained, no civil proceedings by way of summons or notice of motion shall be instituted against any member of the Court, and no subpoena in respect of civil proceedings shall be served on any member of the Court, except with the consent of the- |
a) | Chief Justice, in the case of the President of the Court; or |
b) | President of the Court, in the case of any other judge of the Court. |
2) | Where consent has been granted as contemplated in subsection (1), the date upon which the member of the Court concerned must attend court shall be determined in consultation with the Chief Justice or the President of the Court, as the case may be. |
