I, MANDISI MPAHLWA, Minister of Trade and Industry, hereby, in terms of section 39 of the Copyright Act, 1978 (Act No. 98 of 1978), publish Regulations on the Establishment of Collecting

In the main the Regulations provide for the following:
1. | Criteria to be followed by the accrediting authority (Registrar of CIPRO) |
2. | Powers and functions of the Registrar |
3. | Obligations of collecting societies |
4. | Administration of rights |
5. | Licensing |
6. | Distribution |
7. | Entry into force |
The scope of the Regulations is the one described in terms of section 9A of the Copyright Act, 1978 and section 5(3) of the Performers Protection Act, 1967. During stakeholder consultations, there was a common understanding that all rights in the copyright regime should be managed through collecting societies in future.
During stakeholder consultations there was a common understanding that the Regulations will not apply to Community Radio Stations.
