I, Alexander Erwin, Minister of Trade and Industry, herewith make a regulation in terms of section 24 of the Counterfeit Goods Act, 1997 (Act No 37 of 1997), as set out in the attached schedule.

1. | In this notice, unless the context indicates otherwise— |
"a certificate in the prescribed form"
means the following document issued to an inspector appointed or any specified class or category of persons designated to be inspectors by the Minister of Trade and Industry:
"APPOINTMENT AS INSPECTOR / DESIGNATION OF INSPECTORS IN TERMS OF THE COUNTERFEIT GOODS ACT, 1997 (ACT NO 37 OF 1997)

I, .................................., duly authorized in terms of section 22(3) of the Counterfeit Goods Act, No 37 of 1997 (the Act), and acting under the authority by the Minister of Trade and Industry hereby certify that
(whichever is applicable)
you, ................................... (the inspector's name), ID No: ………………………............., by virtue of section 22 of the Act, have been appointed as an inspector
or
……………................... (specified class or category of persons), by virtue of section 22 of the Act, have been designated to be inspectors
(whichever is applicable)
with effect from the date of this document. During the performance of any functions in terms of the Act, you must have this certificate of appointment and your identity book in your possession and show it at the request of any person affected by the performance of that function.
In order to ascertain whether the Act is being observed by any person to whom it applies, or to obtain any information required in terms of the Act, you may as an inspector, subject to section 4, 5 and 6 of the Act, at all reasonable times enter any premises.
In terms of section 18 of the Act a person will be guilty of an offence upon failing to comply with any request, direction, demand or order made or given by an inspector in accordance with the provisions of the Act. A person will also be guilty of an offence when obstructing or hindering an inspector in performing his or her functions under the Act or when, if asked in terms of section 5(1)(f) of the Act for information or an explanation relating to a matter within the knowledge of that person, he or she refuses or fails to give that information or explanation; or gives information or an explanation knowing it to be false or misleading.".
