Criminal Procedure Act, 1977 (Act No. 51 of 1977)Chapter 20 : Preparatory Examination143. Accused may inspect preparatory examination record and is entitled to copy thereof |
(1) | An accused who is arraigned for sentence or for trial under section 139 may, without payment, inspect the record of the preparatory examination at the time of his arraignment before the court. |
(2) |
(a) | An accused who is arraigned for sentence or for trial under section 139 shall be entitled to a copy of the record of the preparatory examination upon payment, except where a legal practitioner under the Legal Aid South Africa Act, 2014, or pro Deo counsel is appointed to defend the accused or where the accused is not legally represented, of a reasonable amount not exceeding twenty-five cents for each folio of seventy-two words or part thereof. |

(b) | The clerk of the court shall as soon as possible provide the accused or his legal advisor with a copy of the preparatory examination record in accordance with the provisions of paragraph (a). |
