(1) | A designated court must ensure that an accused who is charged with a sexual offence must be granted the opportunity, as soon as possible, to apply for legal aid in terms of the Legal Aid South Africa Act. |
(2) | An application contemplated in subregulation (1) must be evaluated as soon as possible and must to be prioritised where such application relates to a case involving children. |
