| (1) |
Any person who, before or after the commencement of Chapter 6 of the Act, has been convicted of or who has a previous conviction for a sexual offence and who— |
| (a) |
intends to apply for a licence or approval to manage or operate an entity, business concern or trade in relation to the supervision or care of persons who are vulnerable; |
| (b) |
intends to apply to become a foster parent, kinship care-giver, temporary safe care-giver, adoptive parent or curator; or |
| (c) |
wishes to establish whether his or her own particulars appear in the Register, |
must apply to the Registrar, by means of an application form that must correspond substantially with Form 7 in Annexure B to the Regulations, for a certificate stating whether or not his or her own particulars appear in the Register.

| (a) |
employer who, at the commencement of these regulations, employs an employee or intends employing an employee; |
| (b) |
licensing authority who, at the commencement of these regulations, considers an application contemplated in subregulation (1)(c); or |
| (c) |
relevant authority who, at the commencement of these regulations, considers an application contemplated in subregulation (1)(d), |
must apply to the Registrar, by means of an application form that must correspond substantially with Form 8 in Annexure B, for a certificate stating whether or not the particulars of such person appear in the Register.
