I, Mr Mpho Franklyn Parks Tau, in my capacity as the Minister of Trade, Industry and Competition, in relation to the published Government Gazette Vol 708 No 50833 dated 19 June 2024, do hereby in terms of section 10 of the Housing Development Schemes for Retired Persons Act, 1988 (the Act), grant Helderberg Society for the Aged (SHFA) exemption from the provisions of regulations 1, 2, 5(d), 5(r), 5(t) and 6-14 of the Act, with respect to the following Life Right Development Centre, namely - Bowden Park Retirement Village, subject to the below conditions:
(a) | The exemption is valid for a period of five (5) years effective from the publication date of this Notice; |
(b) | HSFA must submit to the Department of Trade, Industry and Competition (the dtic) annual audited financial statements and a report annually on the implementation status and impact of the exemptions to the life right owners; |
(c) | HSFA must adhere to all legislation providing protection to older persons, such proof to be submitted to the dtic annual; and |
(d) | HSFA to provide any other information relevant to the granted exemption. |
