Whenever an employer pays any sum of money that is due to the Council in terms of this Agreement in any manner other than in cash, and such payment is dishonoured for any reason whatever, then and in such event a penalty shall be payable by the employer to the Council in its sole discretion, which penalty shall be equal to 1.5 percent of the amount of the purported payment. Any penalty due to the Council in terms of this clause shall be payable on demand.
