(1) | An employee who is required to work away and spend a night away from his ordinary place of residence shall be paid a living-away allowance of a minimum of the amounts as per the table below per day and the employee shall be provided with suitable accommodation by the employer in respect of each night he is required to spend away from his ordinary place of residence. |

The allowance applicable from 1 November 2019 shall be increased by the CPI percentage (as at the 1st of July 2020 as published by the Statistics South Africa) provided that the minimum increase shall be 4 %. |
The allowance applicable from 1 November 2020 shall be increased by the CPI percentage (as at the 1st of July 2021 as published by the Statistics South Africa) provided that the minimum increase shall be 4 %. |
(2) | Suitable accommodation: the accommodation shall be appropriate for its location and be dean, safe and, at a minimum, meet the basic needs of workers, It must take into account, but is not restricted, to the following considerations: the provision of minimum amounts of space for each worker; provision of sanitary, laundry and cooking facilities, potable water; the location of accommodation in relation to the workplace; any health, fire safety or other hazards; the provision of first aid and medical facilities; and heating and ventilation. |
