Estate Brandy Scheme

19. Presentation for certification

 

(1)

(a)        An application for the certification of estate brandy shall—

(i)        be made on a form obtainable from the Authority for this purpose; and

(ii) be accompanied by one specimen of each of the labels affixed to the containers of the estate brandy concerned.
(b) The applicable fee determined by the Authority for this purpose shall be payable in respect of such application.
(c) Separate applications shall be submitted thus in respect of estate brandy of which the particulars are recorded on separate distillate records.

 

(2) If an applicant has notified the Authority at least three working days beforehand of his intention to lodge such application, that application may be handed to an official or representative of the Authority when he inspects the records and sheets referred to in subsection (3)(a).

 

(3) An application referred to in subsection (1) shall be approved only if the Authority is satisfied that—
(a) it appears from the production sheet, wine record, blending sheet and distillate record concerned, as well as from any other particulars at the disposal of the Authority, that the provisions of this Scheme and the conditions determined by the Authority have been complied with in connection with the estate brandy concerned;
(b) the estate brandy concerned complies with the applicable requirements set out in the regulations made under the Act; and
(c) the applicable labels and seals have been affixed to or placed on the containers of such estate brandy.

 

(4)        The certification of estate brandy shall be confirmed by means of a certificate in the form determined by the Authority.
