Chapter VI : Special Shipping Enquiries and Courts of Enquiry and Courts of Survey

279. Interested persons not to serve on courts of marine enquiry, maritime courts or courts of survey

 

(1) No person who is connected, directly or indirectly, with the ship which forms the subject of investigation by a court of maritime enquiry or a maritime court, or which forms the subject of an appeal to a court of survey, or on board which the casualty or occurrence or conduct to be investigated by a court of marine enquiry or a maritime court took place, or with the owners of that ship, shall be appointed as a member of that court or under section two hundred and eighty-two.

 

(2) Nothing in subsection (1) contained shall prohibit the appointment as a member of a court of marine enquiry or a maritime court or a court of survey or under section two hundred and eighty-two of any person who is in the employ of or entitled to receive a pension from the Government of the Republic, merely on the ground that the said Government is the owner of the ship referred to in subsection (1).
