A person is required to pass the colour and form vision tests set out in the Code if that person's intended duties as a seafarer include watchkeeping duties in the deck or engine department and that person—

(a) | is to be employed or indentured as contemplated in section 92 of the Act; or |
(b) | is an applicant for certification in terms of the seafarer certification regulations and is required to produce an eyesight certificate. |
