(1)	Where an application is submitted by a repeat contravener, the fine committee must, notwithstanding the quantum calculated pursuant to regulation 4, recommend to the competent authority that the applicant pay the maximum fine amount as specified in section 24G(4) of the Act.

(2)	For the purposes of this regulation, the competent authority may consider the applicant's conduct since 7 January 2005.
