16. Chief Executive Officer of Institute

 

1) The Minister must, after consultation with the board, appoint a suitably qualified as chief executive officer of the Institute.

 

2) A person is disqualified from being appointed or remaining Chief Executive Officer if he or she is subject to any of the disqualifications mentioned in section 8.

 

3) A Chief Executive Officer holds office for a period not exceeding three years and may be reappointed upon expiry of that term of office.

 

4) Subject to the Promotion of Administrative Justice Act, 2000 (Act No. 3 of 2000), the Minister may at any time remove the Chief Executive Officer from office, if the Chief Executive Officer—
a) has repeatedly failed to perform the functions of office efficiently;
b) because of any physical or mental illness or disability, has become incapable of performing the functions of that office efficiently; or
c) is found guilty of misconduct or any offence involving dishonesty.

 

5)
a) Whenever, due to absence or for any other reason, the chief executive officer is temporarily unable to perform the functions of that office, or when that office is vacant, the Board may designate a suitably qualified employee of the Institute to act as chief executive officer until the incumbent of that office resumes the functions of chief executive officer or, as the case may be, the vacancy is filled by the Minister through the appointment of a chief executive officer under subsection (1).
b) While so acting, the designated employee is competent to exercise, and perform all, the functions of the chief executive officer in terms of this Act.
