(1) | An operator must appoint or designate a Security Compliance Officer. |
(2) | The Security Compliance Officer is responsible for ensuring an operator's compliance with the requirements of these Regulations in order to protect railway systems and the environment and to ensure an operator's compliance with the relevant security legislation. |
(3) | The Security Compliance Officer must be delegated with the following responsibilities in accordance with the requirements of these Regulations: |
(a) | development, implementation and enforcement of security policy, plan and procedures; |
(b) | review of security policy, plan and procedures where required; |
(c) | ensuring that security risk assessments are conducted; |
(d) | ensuring the implementation of mitigation measures based on the recommendations made in the risk assessment report; |
(e) | ensuring the reporting of security incidents to the Regulator in accordance with the applicable legislation; |
(f) | ensuring the investigation of security incidents that take place directly or indirectly in connection with that operator's railway operations; |
(g) | implementing safety and security measures and evaluating and improving the effectiveness of these measures; |
(h) | conducting security awareness programmes; and |
(i) | ensuring that persons used in executing security activities are registered with the relevant authority. |
