(1) |
No person shall, except— |
(a) |
for the purpose of carrying out his duties or the performance of his functions under this Act; |
(b) |
for the purposes of legal proceedings under this Act or any other law; |
(c) |
when required to do so by any court or under any law; or |
(d) |
with the written consent of the Minister, |
disclose any information acquired by him in the carrying out of his duties or the performance of his functions under this Act or a scheme and which relates to the business or affairs of another person.

(2) |
Notwithstanding the provisions of subsection (1) the person or body designated in terms of section 24(a) may, in respect of the relevant scheme, furnish to the holder of a plant breeder's right granted under the Plant Breeder's Rights Act, 1976, in respect of a variety, information regarding— |
(b) |
the area of land of each unit for certification for which application for registration in respect of such plants or propagating material has been made; and |
(c) |
the quantity of such plants or propagating material which has been certified. |
