If the Council or the Authority cannot or does not maintain an acceptable standard in the fulfilment of one or more of its functions in terms of this Act or the Levies Act, the Minister may intervene by taking any appropriate step to ensure proper fulfilment of that function, including—
(a) |
issuing a directive to the Council or the Authority, describing the extent of the failure and stating the steps required to remedy the situation; |
(b) |
assuming responsibility for the relevant function or duty to the extent necessary— |
(i) |
to maintain an acceptable standard; or |
(ii) |
to prevent the Council, the Authority or any person appointed by the Council or the Authority, from taking any action which is prejudicial to the objects of the Authority; and |
(c) |
dissolving the Council and appointing a new Council. |
