Chapter 9 : General Aspects in Resolving Complaints

39. Implementation of resolution

(1) Once the parties to a dispute reach an agreement for the resolution of the complaint, the Public Protector shall ensure that such an agreement is reduced to writing and signed by the parties immediately or within seven days after resolving the issue.

 

(2) The agreement shall include time frames for compliance and the Public Protector shall monitor the implementation thereof.

 

(3) If any of the parties to a dispute fail to honour the agreement or to comply with any of their obligations in terms of the agreement, the Public Protector may—
(a) proceed with the investigation of the complaint;
(b) make a determination on the complaint and report on the matter in terms of section 182(1)(b) of the Constitution; or
(c) refuse to deal with the complaint any further.
