(1) | A defendant who after summons has been served upon him has admitted liability and consented to judgment in writing shall— |
(a) | sign the form of consent endorsed on the original summons; or |
(b) | lodge with the clerk of the court the copy of the summons served on him with the form of consent endorsed thereon duly signed by him. |
(2) | It the defendant's consent to judgment is for less than the amount claimed in the summons, he may still enter a written statement of defence in respect of the balance of the claim. Notwithstanding a judgment upon such consent, the action may proceed in respect of such balance and shall be in all subsequent respects an action for such balance. |
