If a Board member contravenes section 18, the Agency or the Minister may, in addition to laying criminal charges, recover from the Board member, through a competent court or by agreement or consent of persons concerned, an amount, paid to that Board member or any other person, which is equivalent to—
| (a) | an amount equal to that benefit if a Board member or any other person received a benefit either directly or indirectly as a result of the Board member’s actions; or |
| (b) | an amount equal to that loss or damage if the Agency has suffered loss or damage as a result of the contravention of section 18. |
