Subpart 4 : Type of Acceptance Certificates

21.04.3 Airworthiness design standards

 

(1) An application for the issuing of a type acceptance certificate for a Class I product shall be accompanied with proof that—
(a) a product concerned complies with the appropriate airworthiness design standards referred to in regulation 21.02.3;
(b) a product concernedcomplies with any special conditions prescribed in terms of regulation 21.02.13;
(c) a feature or characteristic of such product makes it safe for intended use;
(d) any airworthiness design standards not complied with are compensated for by factors providing an equivalent level of safety; and
(e) an aircraft is equipped with an extinguishing agent that is not listed in the 1987 Montreal Protocol on Substances that  Deplete the Ozone Layer, the Eight Edition of the Handbook Annex A, Group II, if that aircraft is—
(i) an aeroplane over 5 700 kg for which application for approval for type acceptance certificate was submitted on or after 2 March 2004;
(ii) a helicopter for which  application for certification was submitted on or after 13 December 2007; or
(iii) an aeroplane over 750 kg but not exceeding 5 700 kg, for which application for approval of type acceptance certificate was submitted on or after 13 December 2007.

(2) An application referred to in subregulation (1) shall also be accompanied by proof that the aircraft is equipped with an extinguishing agent that is not prohibited as prescribed in Document SA-CATS 21, in the case of—
(a) an aeroplane with an MCTOW in excess of 5 700 kg for which application for certification was submitted on or after 2 March 2004;
(b) a helicopter for which application for certification was submitted on or after 13 December 2007; and
(c) an aeroplane with an MCTOW in excess of 750 kg but not exceeding 5 700 kg, for which application for certification was submitted on or after 13 December 2007.
