I, Ebrahim Patel, Minister of Trade, Industry and Competition hereby, in terms of Section 15A of the Merchandise Marks Act, 1941 as amended (Act 17 of 1941 hereinafter referred to as “the Act”), advise that I have designated the 2022 Rugby World Cup 7’s to be hosted from the 1-21 September 2022 as a “protected event”, the details which are as follows.
1. | The protected event status will be conferred on the 2022 Rugby World Cup 7’s to be hosted in South Africa on the understanding that the event is in the public interest and that the SA Rugby Union who are the Organisers of the event (hereinafter referred to as “Organisers”) have created opportunities for South African businesses, in particular those from the previously disadvantaged communities. |
2. | The “protected event” designation is on the understanding that: |
(a) | The procurement policy of the Organisers shall comply with the public sector procurement principles such as procedural and substantive fairness, equity, transparency and competitiveness. |
(b) | The procurement policy of the Organisers shall apply the Department of Trade, Industry and Competition codes of good practice for Broad Based Black Economic Empowerment (B-BBEE) when evaluating suppliers and administrative law principles of fair procedure. |
(c) | The Organisers must submit an impact assessment of the Rugby World Cup 7’s event on communities in South Africa to the Minister of Trade, Industry and Competition at least six months and not more than 12 months after the termination of the “protected event” designation. |
(d) | The date of termination of the “protected event” designation is until the end of the event on the 21 September 2022. |
