| (1) |
Any person or organ of state may apply in writing for exemption from the application of this Act — |
| (b) |
where the Minister responsible for mineral resources is responsible for administering the provision of the Act from which the person or organ of state requires exemption, to the Minister responsible for mineral resources; or |
| (c) |
where the MEC is responsible for administering the provision of the Act from which the person or organ of state requires exemption, to the MEC, |
except the exemption from the requirement to obtain a waste management licence contemplated in Chapter 5.

An application in terms of subsection (1) must be accompanied by— |
| (a) |
an explanation of the reasons for the application; and |
| (b) |
any applicable supporting documents. |
