Legal update: recent amendments to the law

The following laws were recently amended. Of note, the amendments to the Debt Collectors Act require attorneys to register as debt collectors and subjects them to the same law as other debt collectors. The Magistrates Court Act has been amended to regulate the rescission of judgments in certain cases, the manner of issuing garnishee orders, and debt collection proceedings. The Superior Courts Act has also been amended to provide for the rescission of judgments by consent and the rescission of judgments where the judgment debt has been paid.


Recent legal amendments:

The Legal Aid South Africa Act, 2014 (Act No. 39 of 2014) has been amended.

The Superior Courts Act, 2013 (Act No. 10 of 2013) has been amended.

The Prevention and Combating of Trafficking in Persons Act, 2013 (Act No. 7 of 2013) has been amended.

The Criminal Law (Sexual Offences and Related Matters) Amendment Act, 2007 (Act No. 32 of 2007) has been amended.

The Children's Act, 2005 (Act No. 38 of 2005) has been amended.

The Institution of Legal Proceedings against certain Organs of State Act, 2002 (Act No. 40 of 2002) has been amended.

The Promotion of Equality and Prevention of Unfair Discrimination Act, 2000 (Act No. 4 of 2000) has been amended.

The Promotion of Administrative Justice Act, 2000 (Act No. 3 of 2000) has been amended.

The Promotion of Access to Information Act, 2000 (Act No. 2 of 2000) has been amended.

The Debt Collectors Act, 1998 (Act No.114 of 1998) has been amended.

The National Prosecuting Authority Act, 1998 (Act No. 32 of 1998) has been amended.

The Magistrates Act, 1993 (Act No. 90 of 1993) has been amended.

The Sheriffs Act 90 of 1986 (Act No. 90 of 1986) has been amended.

The Occupational Health and Safety Act, 1993 (Act No. 85 of 1993), has been updated.

The South African Schools Act, 1996 (Act No 84 of 1996) has been updated.

The Compensation for Occupational Injuries and Diseases Act, 1993 (Act No. 130 of 1993) has been updated.

The State Liability Act, 1957 (Act No. 20 of 1957) has been amended.

The Magistrates' Courts Act, 1944 (Act No. 32 of 1944) has been amended.

The Administration of Estates Act, 1965 (Act No. 66 of 1965) has been amended.

The Criminal Procedure Act, 1977 (Act No. 51 of 1977) has been amended.

The Small Claims Courts Act, 1984 (Act No. 61 of 1984) has been amended.

The Attorneys Act, 1979 (Act No. 53 of 1979) has been amended.

The Rules Board for Courts of Law Act, 1985 (Act No. 107 of 1985) has been amended.
