The Department of Justice and Constitutional Development has published amendments to the Magistrates' Courts and High Court rules of court, effective 3 July 2026, focusing on the conduct of proceedings and security for costs. The Rules Board for Courts of Law has invited public comment on draft amendments to the Magistrates’ Courts rules governing the sale in execution of immovable property. The Department of Justice & Constitutional Development has gazetted amendments to the Magistrates’ Courts rules, specifically updating the schedules related to fees and tariffs with effect from 2026. The Rules Board for Courts of Law has gazetted new rules for the Children’s Courts under the Children’s Act, No. 38 of 2005, effective 27 March 2026. Substantive amendments to the rules regulating proceedings in the High Court and Magistrates’ Courts will come into effect on 30 January 2026. The Rules Board for Courts of Law has published six draft amendments to the rules regulating the conduct of proceedings in the Supreme Court of Appeal and Magistrates’ Courts, with a public comment deadline of 27 February 2026. The Rules Board for Courts of Law has published a proposal to amend the Uniform Rules of Court to standardise the preparation and filing of heads of argument across all High Court divisions. The Rules Board for Courts of Law has invited public comment on proposed amendments to the Magistrates’ Courts rules concerning the automatic review of eviction orders under land-related legislation. The Rules Board for Courts of Law has released draft rules for the Land Court under the Land Court Act, No. 6 of 2023, with a comment deadline of 27 February 2026. The Rules Board for Courts of Law has gazetted amendments to the rules regulating the conduct of proceedings in the High Court and Magistrates’ Courts, effective November 2025. The Rules Board for Courts of Law has proposed amendments to the Magistrates’ Courts rules and Uniform Rules of Court to prevent the suspension of pleading deadlines during document requests.
