Magistrates' and High Court Rules Amended

Brought to you by SA Legal Academy: The Department of Justice and Constitutional Development has gazetted amendments to the rules regulating proceedings in the Magistrates’ Courts and High Courts.

In terms of the Rules Board for Courts of Law Act, No. 107 of 1985, the Minister of Justice and Constitutional Development has published amendments to the rules regulating the conduct of the proceedings of the several provincial and local divisions of the High Court of South Africa and the Magistrates’ Courts. These amendments are scheduled to come into operation on 15 September 2025.

The updates involve procedural modifications to the following sets of rules:

  • The Uniform Rules of Court (High Court); and
  • The Rules Regulating the Conduct of the Proceedings of the Magistrates’ Courts of South Africa.

What this means for you, your business, or your clients

  • For yourself: You must conduct a detailed review of the amended rules in the Government Gazette to ensure that your litigation templates and procedural knowledge are current before the September 2025 implementation.
  • For your business: Your firm must update its internal compliance manuals and case management systems to reflect the revised court procedures and filing requirements.
  • For your clients: You should inform clients involved in long-term litigation that their matters may be subject to different procedural rules if they extend beyond the 15 September 2025 effective date.
