Court Rules: Amendments Gazetted for High and Magistrates’ Courts

Brought to you by SA Legal Academy: The Rules Board for Courts of Law has published amendments to the Uniform Rules of Court and the Rules Regulating the Conduct of the Proceedings of the Magistrates’ Courts of South Africa.

In terms of the Rules Board for Courts of Law Act, No. 107 of 1985, the Department of Justice & Constitutional Development has gazetted changes governing proceedings in both superior and lower courts. These amendments are scheduled to come into force on 28 November 2025, providing a transition period for legal practitioners to align their processes with the new requirements.

The gazetted changes affect the following regulatory frameworks:

  • The Uniform Rules of Court (High Court of South Africa); and
  • The Rules Regulating the Conduct of the Proceedings of the Magistrates’ Courts of South Africa.

Practitioners should note that while the notices have been gazetted, the specific procedural adjustments contained therein will only become mandatory upon the 28 November 2025 commencement date. This lead time is intended to allow for the update of court forms, internal practice notes, and litigation management software.
