Rules Board for Courts of Law: Correction Notices for SCA and Magistrates’ Courts
Brought to you by SA Legal Academy: The Department of Justice & Constitutional Development has published correction notices for amendments to the rules of the Supreme Court of Appeal and the Magistrates’ Courts.
In terms of the Rules Board for Courts of Law Act, No. 107 of 1985, the Rules Board has issued two correction notices regarding the conduct of proceedings. These notices, published on 24 October 2025, rectify errors in previously gazetted amendments. All corrected provisions are set to come into effect on 28 November 2025.
Scope of Corrections
The corrections apply to two distinct jurisdictions:
- Supreme Court of Appeal: The notice corrects amendments made to the tariff of fees applicable to proceedings within this court.
- Magistrates’ Courts: The notice addresses amendments concerning the service of notices and the delivery of legal documents.
These corrections are intended to ensure procedural certainty and accuracy in the application of court tariffs and service protocols across the South African judiciary.
What this means for you, your business, or your clients
- For yourself: You must review the corrected fee tariffs for the Supreme Court of Appeal to ensure that all future billings and cost estimates prepared after 28 November 2025 are compliant.
- For your business: Update your firm’s standard operating procedures for the service and delivery of documents in the Magistrates’ Courts to align with the corrected regulatory requirements.
- For your clients: Provide clients with updated cost projections for appellate matters, noting the specific fee adjustments mandated by the corrected Supreme Court of Appeal rules.
