Brought to you by SA Legal Academy: The Rules Board for Courts of Law is seeking public input on proposed changes to the procedural framework for the sale in execution of immovable property within the Magistrates’ Courts.

In terms of the Magistrates’ Courts Act, No. 32 of 1944, the Rules Board for Courts of Law, through the Department of Justice & Constitutional Development (DoJCD), has published draft amendments to the rules regulating the procedures for the sale in execution of attached immovable property. These amendments aim to refine the existing protocols followed by the sheriff and the courts when executing judgments against real estate.

The proposed changes focus on the procedural requirements for the attachment and subsequent sale of property, ensuring that the rights of both judgment creditors and debtors are balanced in accordance with constitutional requirements. Stakeholders are invited to review the draft and submit written representations regarding the practical implications of the revised rules.

The deadline for the submission of public comments is 29 May 2026. Submissions should be directed to the Rules Board for Courts of Law to ensure they are considered before the finalisation of the amendment notice.
