RAF Claims Limit Adjusted to R372 824.00

Brought to you by SA Legal Academy: The Road Accident Fund (RAF) has increased the statutory limit for loss of income and loss of support claims to R372 824.00 to account for inflation.

In terms of section 17(4)(c) of the Road Accident Fund Act, No. 56 of 1996, the Fund has issued Board Notice 696 of 2024 (published in Government Gazette 51445) to adjust the cap on claims for loss of income and loss of support. The new limit is set at R372 824.00, effective from 31 October 2024.

This routine quarterly adjustment is mandated to counter the effects of consumer price index (CPI) inflation on the value of the cap originally established in 2008. The adjustment ensures that the real value of the compensation limit is maintained for claimants despite rising costs.

Key Compliance Points

  • The new limit of R372 824.00 applies to all claims for loss of income or loss of support where the cause of action arose on or after 31 October 2024.
  • Practitioners must ensure that all pending and new claims are calculated using the adjusted threshold where applicable.
  • The adjustment does not affect claims for general damages or medical expenses, which are governed by separate provisions of the Act.

What this means for you, your business, or your clients

  • For yourself: Update your personal injury litigation templates and quantum calculation spreadsheets to reflect the new R372 824.00 cap for loss of income and support.
  • For your business: Review all open files and pending settlement negotiations to ensure that claims for loss of income or support are aligned with the latest statutory limit.
  • For your clients: Advise clients with claims arising on or after 31 October 2024 that the maximum recoverable amount for loss of support or income has increased, potentially affecting their final settlement value.
