National Nuclear Regulator Amendment Act, 2024, Commences

Brought to you by SA Legal Academy: The National Nuclear Regulator Amendment Act, No. 13 of 2024, has officially come into force following a presidential proclamation.

In terms of a proclamation published in the Government Gazette, the National Nuclear Regulator Amendment Act, No. 13 of 2024, is now operational. This legislation amends the National Nuclear Regulator Act, No. 47 of 1999, to modernize the regulatory framework governing nuclear safety in South Africa.

The primary objective of the 2024 Amendment Act is to align the principal statute with prevailing international nuclear safety regulatory best practices, specifically those advocated by the International Atomic Energy Agency (IAEA). The Bill was passed by Parliament in May 2024, following its initial tabling in late 2023.

Key regulatory changes introduced by the Amendment Act include:

  • Enhancing the enforcement and oversight capabilities of the National Nuclear Regulator (NNR);
  • Refining the scope of the Regulator’s authority regarding nuclear installations and radioactive waste management;
  • Updating safety standards to protect persons, property, and the environment against nuclear damage; and
  • Improving administrative procedures for licensing and compliance monitoring.
