Justice Minister Outlines Roadmap for Judicial Institutional Independence

In terms of the 2025/26 Budget Vote for the Department of Justice & Constitutional Development, Minister Mmamoloko Kubayi detailed the practical steps being taken to establish the judiciary as a fully-fledged arm of the state. This transition aims to separate the administrative and financial management of the courts from the executive branch, aligning more strictly with the separation of powers doctrine under the Constitution of the Republic of South Africa, 1996.

A task team has been established to facilitate this institutional shift. The team is comprised of senior officials from the Department of Justice & Constitutional Development and the Office of the Chief Justice. The primary objectives of this process include:

  • Charting a legislative and operational path for the judiciary to manage its own administrative affairs.
  • Developing a framework for the judiciary to exercise greater control over its budgetary allocations and human resources.
  • Ensuring that the Office of the Chief Justice has the necessary capacity to function as an independent administrative entity.

The task team is required to present a formal progress report on these developments to Cabinet by the end of August 2025. The Minister indicated that these steps are intended to ensure the judiciary possesses the structural autonomy required to perform its constitutional functions without administrative reliance on the executive.
