Marine Biodiversity: Revised Draft Regulations for Offshore Ship-to-Ship Transfers

The Department of Forestry, Fisheries & the Environment (DFFE) has invited public comment on a revised version of draft regulations intended to reduce the impact of offshore ship-to-ship (STS) transfers on marine biodiversity. The revised proposals, which follow an initial draft released in February 2025, also address bunkering activities defined as the supply of fuel to a vessel at sea outside of an operational harbour area. Stakeholders have until 3 August 2025 to submit input on the revised measures.

The updated draft introduces a refined approach to managing STS transfers, informed by feedback received during the first round of public consultation. The regulations aim to establish a clear framework for activities that pose risks to marine ecosystems, particularly those occurring in sensitive offshore environments. Key elements of the revised proposals include:

  • Management protocols for bunkering services conducted outside designated port limits.
  • Specific requirements for the notification and authorization of ship-to-ship transfers.
  • Measures to mitigate the environmental risks associated with fuel transfers at sea.
