Public Comment Opportunities: August 2025 Legislative Proposals

Under the Constitution of the Republic of South Africa, 1996, specifically sections 59, 72, and 118, Parliament and provincial legislatures are mandated to facilitate public involvement in their legislative and other processes. This regulatory window allows professionals to submit written representations on draft Bills, regulations, and policy frameworks before they are enacted into law.

During August 2025, various departments and regulatory bodies have invited comments on matters including, but not limited to:

  • Draft amendments to existing statutes to align with recent court rulings or policy shifts.
  • New regulations proposed under the Companies Act, No. 71 of 2008 and the Financial Sector Regulation Act, No. 9 of 2017.
  • Sector-specific codes of conduct and technical standards issued by regulatory authorities.

Submission and Compliance

Submissions must be directed to the specific contact person or department listed in the relevant Government Gazette notice. Most notices require submissions to be in writing, often via email or formal post, and must be received by the closing date specified in the notice. Failure to participate during this stage may limit a party’s ability to challenge the procedural fairness of the legislation at a later stage.
