Road Accident Fund: Quarterly Claims Limit Adjustment (July 2025)

Posted 25 July 2025 Written by Acts Online

Brought to you by SA Legal Academy: The Road Accident Fund has announced the quarterly adjustment to the statutory limit for loss of income and loss of support claims, effective from 31 July 2025.

In terms of the Road Accident Fund Act, No. 56 of 1996, the Fund has published Board Notice 813 in Government Gazette No. 53038. This notice adjusts the statutory limit on claims for loss of support or income to R373,822.00. The adjustment is intended to counter the effects of consumer price index (CPI) inflation.

This latest revision follows a previous adjustment published on 16 May 2025, which was retrospectively applicable from 1 May 2025. Practitioners should note that these limits are adjusted quarterly to maintain the real value of the cap established under section 17(4)(c) of the Act.

What this means for you, your business, or your clients

  • For yourself: Update your professional reference files and claim calculation templates to reflect the new R373,822.00 limit for claims arising on or after 31 July 2025.
  • For your business: Ensure that litigation departments and legal accounting software are updated with the revised cap to prevent over-calculation of potential claim values in quantum assessments.
  • For your clients: Advise claimants seeking damages for loss of income or support that the maximum annual amount recoverable from the Fund has been increased to R373,822.00, subject to the date of the accident.
