Railway Safety Act, No. 16 of 2024: Commencement Date Fixed

Brought to you by SA Legal Academy: A presidential proclamation has established the commencement date for the majority of the provisions contained in the new railway safety regulatory framework.

In terms of a proclamation published in the Government Gazette, most sections of the Railway Safety Act, No. 16 of 2024, are scheduled to come into effect on 1 August 2025. This legislation repeals and replaces the National Railway Safety Regulator Act, No. 16 of 2002, while retaining several of its core regulatory elements to ensure continuity in safety oversight.

The Railway Safety Act, No. 16 of 2024, aims to facilitate an efficient and safe railway environment by aligning industry standards with the National Rail Policy. According to the memorandum on the objects of the Bill, the new framework focuses on:

  • Improving safety oversight and the governance of the Railway Safety Regulator;
  • Promoting the use of rail as a safe and competitive mode of transport; and
  • Developing a safety-critical culture within the South African rail industry.

The 1 August 2025 commencement date provides a transition period for the Department of Transport and industry stakeholders to prepare for the shift from the 2002 regulatory regime to the modernized requirements of the 2024 Act.
