IPID Amendment Act 2024: Commencement of Most Sections

Brought to you by SA Legal Academy: The majority of the provisions contained in the Independent Police Investigative Directorate Amendment Act, No. 4 of 2024, have officially commenced.

In terms of a presidential proclamation published in the Government Gazette, the Independent Police Investigative Directorate Amendment Act, No. 4 of 2024, is now in force, with the exception of specific administrative and appointment-related provisions. The Act is designed to strengthen the Directorate’s independence and align its governing legislation with Constitutional Court requirements regarding the appointment and removal of its leadership.

The following sections of the Independent Police Investigative Directorate Amendment Act, No. 4 of 2024, have been excluded from the current commencement and are not yet in operation:

  • Section 6 (Appointment of Executive Director)
  • Section 12 (Appointment of Provincial Heads)
  • Section 14 (Appointment of investigators)
  • Section 16 (Appointment of Secretary)
  • Section 18 (Appointment of Chief Financial Officer)

The sections now in force focus on the institutional and operational independence of the Directorate, ensuring that its mandate to investigate alleged misconduct by members of the South African Police Service and Municipal Police Services is protected from executive interference.
