LPC Proposed Rule Amendments: Provincial Council Vacancies

Brought to you by SA Legal Academy: The Legal Practice Council has announced proposed amendments to the rules governing the filling of vacancies within its provincial structures.

In terms of the Legal Practice Act, No. 28 of 2014, the Legal Practice Council (LPC) has gazetted a notice of intention to amend the rules relating to the filling of vacancies on provincial councils. A correction notice was subsequently published on 11 August 2025 in Government Gazette No. 53142, under General Notice 3425, to formalise the call for public comment.

The proposed amendments focus on the regulatory framework for by-elections. Specifically, the changes seek to clarify the procedures and conditions under which a by-election must be conducted when a vacancy arises in a provincial council. This ensures that the governance of the legal profession remains representative and compliant with the statutory requirements of the Act.

Interested parties and legal practitioners are invited to submit written comments on the proposed rule changes. The deadline for submissions is 5 September 2025.
