Withdrawal of Draft National Credit Act Regulatory Amendments
Brought to you by SA Legal Academy: The Department of Trade, Industry and Competition (DTIC) has formally withdrawn draft amendments to regulations under the National Credit Act, No. 34 of 2005, which were previously gazetted for public comment.
In terms of the National Credit Act, No. 34 of 2005, the DTIC had initially called for public input by 12 September 2025 on proposed regulatory changes. However, on 12 September 2025, the department issued a media statement announcing the immediate withdrawal of these draft amendments to facilitate further engagement with stakeholders.
The department indicated that further consideration is required to refine the regulatory framework in two primary areas:
- The enhancement of protections for students engaging with credit products; and
- Ongoing efforts to improve access to finance for micro, small, and medium enterprises (MSMEs).

- For your business: Compliance and risk departments should pause any implementation plans or internal policy updates that were being drafted in anticipation of these specific regulatory changes.
- For your clients: Credit providers and MSME clients should be advised that the current regulatory environment under the National Credit Act, No. 34 of 2005 remains in force without the proposed modifications for the time being.
