Brought to you by SA Legal Academy: In terms of a media statement regarding Cabinet meetings held on 22 July and 6 August 2025, the Repeal of South African Airways (SAA) SOC Limited Bill is to be withdrawn from Parliament’s legislative programme.

The Bill, which was originally tabled in January 2024, was intended to facilitate the ‘repositioning and restructuring’ of the national carrier. Specifically, the legislative framework sought to provide for a strategic equity partner to take up a 51% shareholding in South African Airways (SAA) SOC Limited.

The decision to withdraw the Bill follows the collapse of negotiations between the concerned parties less than two months after the Bill’s initial introduction. This collapse rendered the Bill “unimplementable” and invalidated the conditions underpinning the transaction envisaged at the time of drafting.

The legislative history of the Bill includes the following milestones:

  • January 2024: Bill tabled in Parliament to enable the 51% equity transfer.
  • May 2024: Bill lapsed when Parliament rose for the general elections.
  • July 2024: Bill was revived in the legislative programme.
  • August 2025: Cabinet approves formal withdrawal due to the failure of the underlying commercial transaction.
