Brought to you by SA Legal Academy: The President has signed the Eskom Debt Relief Bill and the Public Sector Pension & Related Payments Bill into law, following their tabling with the 2025/26 Budget.

In terms of the Public Sector Pension & Related Payments Act of 2025, specific financial obligations regarding state employees have been restructured. The Act mandates that certain public sector pension benefits, post-retirement medical benefits, and other pension-related benefits arising from legislation or collective agreements are now classified as direct charges against the National Revenue Fund. This shift ensures that these obligations are prioritised and funded directly from the central national account rather than through individual departmental appropriations.

The Eskom Debt Relief Act of 2025 provides the legal mechanism for the continued implementation of the debt relief arrangement for the national utility. Both pieces of legislation were originally tabled in March 2025 and were passed by Parliament four months later. These Acts are now in force and join the statute books with immediate effect.
