Children’s Act: Draft Amendment Bill Gazetted for Comment

Brought to you by SA Legal Academy: The Department of Social Development has published a draft Children’s Amendment Bill for public comment. The proposed amendments aim to refine the existing legislative framework to better address contemporary issues in child welfare and social development.

In terms of the Children’s Act, No. 38 of 2005, the Department of Social Development has gazetted the draft Children’s Amendment Bill. Stakeholders and interested parties have until 26 October 2025 to submit written inputs and comments on the proposed changes. The draft follows Cabinet deliberations regarding the enhancement of child protection services and the operational efficiency of the existing Act.

While the formal memorandum on the objects of the Bill is awaiting final release, the draft legislation is expected to address several regulatory areas once passed and enacted:

  • Refining the procedures for child protection interventions and the placement of children in alternative care.
  • Addressing gaps in the oversight and registration of child care facilities and services.
  • Aligning the Children’s Act, No. 38 of 2005 with recent judicial rulings and evolving international standards for child welfare.

The Department has indicated that the draft Bill seeks to streamline administrative processes within the social development sector to ensure more rapid response times in child-related matters. The comment period provides an opportunity for legal and compliance professionals to influence the final technical drafting of the Bill.
