Brought to you by SA Legal Academy: An ad hoc committee of the National Assembly, established in July 2025, has invited stakeholders to provide written submissions concerning the veracity and implications of allegations regarding the criminal justice system.

The investigation follows allegations made by Lieutenant-General Nhlanhla Mkhwanazi, which the committee describes as ‘wide-ranging’ with significant implications for national security matters. The scope of the committee’s work includes examining criminality, political interference, and corruption within the broader security and justice framework.

This parliamentary process is running parallel to a formal judicial inquiry into the same matters. The judicial inquiry is chaired by Judge Mbuyiseli Madlanga and focuses on the systemic failures and external pressures affecting the independence of the criminal justice system.

Submission Requirements

The committee is seeking input from interested parties to assist in its investigation. Key areas of focus include:

  • Allegations of political interference in investigative and prosecutorial processes;
  • Corruption within the security services and the South African Police Service; and
  • The impact of these factors on the rule of law and public safety.

What this means for you, your business, or your clients

  • For yourself: No direct individual filing requirement; however, legal practitioners should monitor the proceedings for potential impacts on the interpretation of prosecutorial independence.
  • For your business: Firms operating in the compliance and forensic sectors should assess how the findings may alter the regulatory landscape for reporting corruption or dealing with state security entities.
  • For your clients: Clients involved in high-profile litigation or matters involving state security should be advised on the potential for systemic shifts in the criminal justice framework following the committee’s report.
