National Consumer Commission Withdraws 2011 Enforcement Guidelines

Brought to you by SA Legal Academy: The National Consumer Commission (NCC) has issued a notice in the Government Gazette withdrawing the enforcement guidelines that have been in effect since July 2011.

In terms of the Consumer Protection Act, No. 68 of 2008, the National Consumer Commission has officially rescinded the enforcement guidelines originally published in July 2011. This withdrawal follows concerns raised during various proceedings before the National Consumer Tribunal (NCT) regarding material inconsistencies between the 2011 guidelines and the substantive provisions of the Consumer Protection Act, No. 68 of 2008.

The enforcement guidelines were originally designed to outline the Commission’s approach to investigations and the exercise of its regulatory powers. However, the NCT found that certain procedural aspects of the guidelines did not align with the statutory framework, leading to legal uncertainty during enforcement actions. The withdrawal of these guidelines means that the Commission’s enforcement activities must now be interpreted solely through the lens of the Act and its accompanying Regulations until such time as new, aligned guidelines are promulgated.
