CIPC Clarifies Dating of Business Rescue Status Report Form (CoR125.1)
Brought to you by SA Accounting Academy: The Companies and Intellectual Property Commission (CIPC) has issued Practice Note 5 of 2025 to clarify the correct dating procedure for the business rescue status report form (Form CoR125.1).
In terms of section 132(3) of the Companies Act, No. 71 of 2008, if a company’s business rescue proceedings have not concluded within three months after their commencement, or within a longer timeframe permitted by a court upon application, the Business Rescue Practitioner (BRP) must prepare and file regular status reports.
The CIPC has noted persistent confusion among BRPs regarding the date field on Form CoR125.1. Many practitioners have been inserting the date on which they physically completed the form, rather than the actual date of the status report itself. Practice Note 5 of 2025 clarifies that the date entered on Form CoR125.1 must reflect the specific date of the report.
This practice note is issued pursuant to Regulation 4(1)(b) of the Companies Regulations, 2011, which empowers regulatory bodies to issue practice notes outlining procedures to be followed or interpreting provisions of the Act and its regulations.
